Rider Waiver

WHEELIE SIMULATOR PARTICIPATION AGREEMENT, ASSUMPTION OF RISK, RELEASE OF LIABILITY AND INDEMNITY

Please read and fill out the following form.

1. ACKNOWLEDGEMENT OF RISKS

I acknowledge and understand that participation in the Activity involves inherent risks, hazards and dangers which may result in injury, illness, psychological trauma, property damage, permanent disability or death.

I understand that such risks may arise from, including but not limited to:

• Loss of balance or control whilst participating;

• Sudden movement, acceleration, deceleration or mechanical operation of the simulator;

• Failure or malfunction of equipment;

• Slips, trips and falls;

• Collision with equipment or surrounding structures;

• Actions, omissions or negligence of other participants;

• Weather conditions and environmental factors where applicable;

• My own physical condition, reactions, fitness or failure to follow instructions.

I acknowledge that these risks cannot be completely eliminated without jeopardising the essential qualities of the Activity.

2. FITNESS TO PARTICIPATE

I confirm that:

• I am physically and mentally capable of participating in the Activity.

• I am not under the influence of alcohol, drugs or any substance that may impair my judgement or ability to participate safely.

• I do not suffer from any medical condition, injury or disability that may make participation unsafe.

• I will immediately inform Real Action Ltd of any condition that may affect my ability to participate safely.

I understand that Real Action Ltd reserves the right to refuse participation to any person it reasonably believes may be unable to participate safely.

3. ASSUMPTION OF RISK

To the fullest extent permitted by law, I voluntarily and freely assume all risks associated with participation in the Activity, whether known or unknown, foreseeable or unforeseeable, including risks arising from the condition of the premises, equipment, or the actions of other participants.

I accept personal responsibility for my participation and for any injury, loss or damage that may occur as a result of my participation.

4. COMPLIANCE WITH INSTRUCTIONS

I agree to:

• Follow all safety rules, instructions and warnings provided by Real Action Ltd and its staff;

• Use all safety equipment as instructed;

• Operate the simulator only in the manner directed by staff;

• Immediately cease participation if instructed to do so.

I understand that failure to comply with instructions may result in my removal from the Activity without refund and may increase the risks involved.

5. RELEASE OF LIABILITY

To the fullest extent permitted by law, I release and discharge Real Action Ltd and its directors, officers, employees, contractors, agents, representatives, volunteers, sponsors, landowners and event organisers (“Released Parties”) from any and all claims, demands, actions, proceedings, damages, losses, liabilities, costs and expenses arising out of or in connection with my participation in the Activity.

Nothing in this Agreement shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded or restricted under applicable law.

6. INDEMNITY

To the fullest extent permitted by law, I agree to indemnify and keep indemnified the Released Parties against any claims, liabilities, damages, costs, losses or expenses arising from:

• My breach of this Agreement;

• My failure to follow instructions or safety requirements;

• Any negligent, reckless or deliberate act or omission by me;

• Any claim brought by a third party arising from my conduct whilst participating in the Activity.

7. DAMAGE TO EQUIPMENT

I acknowledge that equipment used in connection with the Activity remains the property of Real Action Ltd.

I agree to:

• Use all equipment responsibly and in accordance with instructions;

• Report any apparent defect or damage immediately;

• Refrain from misuse, reckless operation or unauthorised modification of any equipment.

I accept responsibility for any loss of or damage to equipment caused by my negligent, reckless, wilful or deliberate actions and agree to reimburse Real Action Ltd for the reasonable costs of repair or replacement.

8. PERSONAL PROPERTY

I understand that I am solely responsible for my personal belongings.

To the fullest extent permitted by law, Real Action Ltd accepts no responsibility for loss, theft or damage to personal property brought onto the premises or event site.

9. PHOTOGRAPHY AND MEDIA CONSENT

I consent to Real Action Ltd taking photographs and video recordings of me during the Activity and using such images for promotional, marketing and social media purposes without compensation.

10. SEVERABILITY

If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

11. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

PARTICIPANT DECLARATION

By signing below I confirm that:

• I have carefully read and fully understood this Agreement;

• I have had the opportunity to ask questions regarding its contents;

• I understand that I am giving up certain legal rights;

• I sign this Agreement voluntarily and without inducement;

• I am at least 18 years of age, or if participant is under 18, this Agreement is signed by their parent or legal guardian.

PARTICIPANT SIGNATURE

PARENT OR LEGAL GUARDIAN CONSENT (FOR PARTICIPANTS UNDER 18)

I am the parent/legal guardian of the above-named participant and consent to their participation in the Activity.

I confirm that I have read and understood this Agreement and agree, to the fullest extent permitted by law, to be bound by its terms on behalf of myself and the minor participant.
